1. Agreement to These Terms
These Terms of Service ("Terms") are an agreement between you and Morie ("Morie," "we," "us," or "our"). They govern your access to and use of the Morie mobile application, websites, subscriptions, support, and related services (collectively, the "Service").
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The Morie Service
Morie is a nutrition and progress tracking app that may include:
- Food logging by text, saved meals, and image-based scan flows.
- AI-assisted food identification and nutrition estimation.
- Calories, macros, sugar, fiber, sodium, streaks, and daily progress views.
- Profile-based calorie and nutrition targets based on age, gender, height, weight, activity, and goal inputs.
- Weight progress tracking, statistics, and home widget summaries.
- Optional meal reminders, notification preferences, and Apple Health activity context.
- Optional paid features through Morie Pro or other subscription offerings.
We may modify, suspend, discontinue, or limit any part of the Service at any time, including features, plans, integrations, and availability.
3. Accounts and Eligibility
You must be at least 13 years old to use Morie. If the laws where you live require a higher minimum age, you must meet that higher age requirement.
When you create or use an account, you agree to:
- Provide accurate and current information.
- Keep your login credentials secure.
- Be responsible for activity under your account.
- Notify us if you believe your account has been compromised.
We may refuse, suspend, or terminate access if we believe your use violates these Terms, creates risk, or may harm Morie, other users, or third parties.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, abusive, or unauthorized purposes.
- Interfere with, disrupt, reverse engineer, scrape, or attempt to access non-public parts of the Service.
- Upload malware, exploit vulnerabilities, or bypass security or subscription controls.
- Submit content that infringes, violates privacy rights, or is misleading, abusive, or otherwise objectionable.
- Use Morie to provide medical, clinical, or emergency services to yourself or others.
- Misrepresent AI estimates, nutrition data, or app output as professional medical advice.
5. Health and Medical Disclaimer
The Service provides general wellness, nutrition tracking, and informational tools only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult qualified healthcare professionals before making significant diet, weight, exercise, supplement, or medical decisions, especially if you have medical conditions, allergies, are pregnant, have a history of eating disorders, or are following clinical nutrition guidance.
If you experience a medical emergency or urgent health concern, contact emergency services or a qualified healthcare provider immediately.
6. AI, Food Recognition, and Nutrition Estimates
Morie may use AI models and related backend services to analyze food descriptions or images and provide estimated food names, quantities, calories, macros, and other nutrition details.
AI-assisted outputs may be inaccurate because of factors such as:
- Photo quality, hidden ingredients, cooking method, portion size, brand, recipe variation, or user input ambiguity.
- Model limitations, incomplete nutrition databases, or calculation assumptions.
- Changes you make to logged foods after analysis.
You are responsible for reviewing, editing, and deciding whether to rely on any nutrition estimate. Morie does not guarantee that calories, macros, activity burn, weight projections, or target calculations are complete, current, or accurate.
7. Subscriptions and Payments
Some Morie features may require a paid subscription, such as Morie Pro. Subscription offerings, pricing, free trials, renewal periods, taxes, and cancellation options may be shown in the app store, RevenueCat-powered purchase flow, or other payment interface.
When you purchase a subscription:
- You authorize the applicable app store or payment provider to charge your selected payment method.
- Subscriptions may renew automatically unless canceled before the renewal date.
- You are responsible for managing cancellation through the app store or subscription settings that processed the purchase.
- Refunds are handled by the applicable app store, payment provider, or mandatory law.
- We may change subscription features or pricing, with notice where required.
If a subscription cannot be verified, expires, is canceled, or is reversed, paid features may become unavailable.
8. Your Content and License to Operate the Service
You may submit food descriptions, meal photos, food logs, saved meals, weight entries, preferences, and other content to the Service ("User Content"). You retain ownership of your User Content.
You grant Morie a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and create technical or analytical derivatives of User Content only as reasonably necessary to operate, secure, support, and improve the Service, including AI analysis and sync features.
You represent that you have the rights needed to submit your User Content and that your User Content does not violate law or third-party rights.
9. Privacy
Our Privacy Policy explains how we collect, use, share, and retain information. By using Morie, you agree to the practices described there.
10. Third-Party Services
Morie may rely on or integrate with third-party services such as app stores, authentication providers, cloud hosting, analytics, subscription management, AI processing, Apple Health, device permissions, and notification services.
Third-party services may have their own terms, privacy policies, and controls. We are not responsible for third-party services that we do not own or control.
11. Intellectual Property
Morie, including its app design, code, branding, text, graphics, interfaces, features, and other materials, is owned by us or our licensors and protected by intellectual property laws.
These Terms do not grant you ownership of Morie or any right to use our name, logo, branding, or proprietary materials except as necessary to use the Service as permitted.
12. Termination
You may stop using Morie at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk, caused harm, or used the Service in a way that may expose Morie or others to liability.
After termination, provisions that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind.
We do not warrant that the Service will be uninterrupted, secure, error-free, medically appropriate, nutritionally accurate, or available on every device or in every location. You use the Service at your own discretion and risk.
14. Limitation of Liability
To the maximum extent permitted by law, Morie and its affiliates, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, health decisions, nutrition decisions, or reliance on AI or app-generated estimates.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Morie for the Service in the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing.
15. Indemnity
You agree to defend, indemnify, and hold harmless Morie from claims, liabilities, damages, losses, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of law or third-party rights.
16. Governing Law and Disputes
These Terms will be governed by the laws of the jurisdiction where Morie is operated, without regard to conflict of law rules, unless mandatory consumer protection laws require otherwise.
Before filing a formal claim, you agree to contact us and try to resolve the dispute informally. Nothing in these Terms limits rights that cannot be waived under applicable law.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as updating the effective date, posting revised Terms, or providing in-app or email notice where appropriate. Continued use of the Service after changes become effective means you accept the revised Terms.
